4Evafans is operated by INSTANT VERIFIED MEDIA LTD, a company registered in Cyprus. Registered office: 77 Strovolou Avenue, Strovolos Center, 4th Floor, Office 401, 2018, Nicosia, Cyprus. 

1. Introduction

These Terms of Use constitute a legally binding agreement between you and INSTANT VERIFIED MEDIA LTD regarding your use of the 4Evafans platform. By accessing or using the site, you agree to be bound by these Terms. If you do not agree, do not use the site.

2. Definitions

• "4Evafans": The website operated by INSTANT VERIFIED MEDIA LTD, accessible at www.4evafans.com.
• "User": Any person using 4Evafans, including Creators and Fans.
• "Creator": A User who uploads and monetises content on 4Evafans.
• "Fan": A User who pays to access a Creator’s content or interact with a Creator.
• "Content": All media uploaded by Users, including photos, videos, text, audio, livestreams, etc.
• "Subscription": A recurring payment that grants a Fan access to a Creator’s content.
• "Fan Payment": Any payment made by a Fan for access to content or services.
• "Creator Earnings": The portion of Fan Payments received by the Creator after platform fees and any applicable taxes.
• "Payout Method": The mechanism by which Creator Earnings are withdrawn (e.g., bank account, e-wallet).

3. Eligibility

To use 4Evafans, you must:

• Be at least 18 years of age;
• Be legally permitted to use the platform in your jurisdiction;
• Not be a convicted offender of any serious criminal act.

4. Account Requirements

Users must register for an account with a valid email and create a secure password. Creators must provide identity verification and valid payout details.

5. Content and Conduct

• You are responsible for your uploaded Content.
• Content must comply with local laws and our Acceptable Use Policy.
• You must not infringe on any third-party intellectual property rights.
• You must not upload harmful, abusive, or illegal content.

6. Co-authored Content

If your Content includes other individuals, you must have their written consent and ensure they meet the platform’s eligibility requirements.

7. Subscriptions and Fan Payments

• Subscriptions auto-renew unless cancelled by the Fan.
• Creators determine their own pricing.
• Payments are handled by third-party providers.
• Currency conversion or banking fees may apply.

8. Creator Earnings and Payouts

• Creators earn 80% of each Fan Payment.
• Payments are subject to a minimum payout threshold.
• We are not responsible for delays caused by third-party providers.
• If a chargeback or refund occurs, that amount may be deducted from Creator Earnings.

9. Taxes

Creators are solely responsible for all applicable tax filings and obligations under Cyprus law or the law of their country of residence. INSTANT VERIFIED MEDIA LTD does not offer tax advice or withhold taxes on behalf of users.

10. Refunds and Chargebacks

Refunds are generally not available unless required by law. If you believe a charge is in error, contact us at admin@4evafans.com. Abuse of chargeback policies may lead to account termination.

11. Advertising Content

Creators who post paid advertising must disclose such content clearly (e.g., using #ad or #sponsored) and ensure it complies with relevant laws.

12. Intellectual Property

• You retain ownership of all Content you upload.
• You grant 4Evafans a worldwide, royalty-free, sublicensable license to use your Content for the operation of the platform.
• We may take action on your behalf to report copyright infringement.

13. Suspension and Termination

We reserve the right to suspend or terminate accounts that violate our terms. Users may delete their account through the account settings. Creator earnings may be withheld if violations occur.

14. Platform Availability

We do not guarantee uninterrupted access to 4Evafans. We may suspend the site for maintenance or security purposes at our discretion.

15. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages. Our liability is limited to the greater of EUR €5,000 or the amount you paid to us in the last 12 months.

16. Dispute Resolution and Governing Law

• This agreement is governed by the laws of the Republic of Cyprus.
• You agree to attempt good faith mediation before filing any legal claim.
• Disputes shall be brought exclusively before the courts of Nicosia, Cyprus.

17. Referral Program

WARNING!
In compliance with applicable European and Cypriot commercial and consumer protection regulations, we are required to provide the following notice regarding the 4Evafans Referral Program:

• It is illegal for us or any participant in the Referral Program to persuade anyone to make a payment by promising benefits from getting others to join the Referral Program.
• Do not be misled by claims that high earnings are easily achieved through participation in the Referral Program.
• Although no payment is required to join the Referral Program, you have the right to cancel your participation within 14 days with no obligation or penalty.

Referral Structure

The 4Evafans Referral Program allows Users ("Referring Users") to earn commission on Fan Payments generated by Creators they refer ("Referred Creators"). Commission is paid monthly based on the Referred Creator’s total monthly earnings, according to the following tiered system:

The maximum total referral payout per Referred Creator is USD $50,000. Once this cap is reached, no additional commission will be paid for that Creator.

Eligibility and Rules

• You must have an active 4Evafans User account to participate.
• You must submit valid payout information in order to receive referral payments.
• You may not refer yourself or any account you operate or have a commercial relationship with.
• All referral activity must be truthful and not misleading. You must not imply that 4Evafans endorses your promotion of the Referral Program.
• Referral tracking relies on your unique referral link and browser cookies. We are not responsible for referrals that cannot be tracked due to browser settings, ad blockers, or user error.

Payment Terms

• Referral payments are calculated monthly and distributed on or around the first calendar day of the following month.
• All referral payments are inclusive of any applicable VAT or indirect taxes.
• Referral payments will only be issued via an approved payout method linked to your account.
• We may withhold referral payments in cases of fraud, abuse, Terms of Use violations, or legal non-compliance.

Changes and Termination

• We reserve the right to modify, suspend, or terminate the Referral Program at any time.
• Changes to the program will not impact referral payments already earned prior to such changes.
• If a Referred Creator closes their account, opts out of the program, or is removed for a Terms breach, referral payments on their activity will cease.

18. Final Terms

• If any clause in these Terms is found unenforceable, the remainder remains valid.
• We may assign our rights and obligations without your consent.
• This agreement constitutes the entire agreement between you and us.
